I don't think "Fuzzball" has any idea what he's going to do next. He's stalling and trying to fight a multi-pronged war by simply running in circles.
Hell of a game plan there.
Had Susman entered the court tomorrow fighting for an examiner with Rosen saying "We asked for 2 weeks to get it all to them, we couldn't get it al to them by today" Susman could have said "Yeah, and we would have given them 2 weeks if they held off on the DS. But... since we can't trust them, ans they're trying to rush full speed ahead towards confirmation, this simply cannot wait."
Rosen worked his tail off to force a delay in the examiner motion or to have some clout to use against the EC in court.
Above all else Weil was operating under the hope of getting the DS approved tomorrow. Susman negated that by wrangling a "good faith" delay on the DS with the threat of twisting that around as justification for the dire timely need of an examiner.
How could Rosebuds NOT have seen that coming.
He's outclassed... that's how.
There are no time outs left. From here on out Susman will use any stall tactics on Weil's part to further delay the DS.
Every time Rosebuds pulls one of those magic delay rabbits out of his hat, he'll only be shooting himself in the foot.
The best part is that the judge knows exactly what Fuzzy is up to and she doesn't appear to appreciate it. The more they quote her words "examined to death", the more likely she is to appoint an examiner.
Right now, "Examined to death" is their one and only argument.
