La presentación bonita de cara a la galería, más serio que la patética presentación del becario que vaya tela. Pero para mi falta de "chicha" toca muchos temas pero como los demuestra donde están los reports, donde las pruebas irrefutables???

Las tiene ya la Juez mira el escrito del EC que tiene la Juez con las pruebas cronológicas detalladas. Lo ha dicho muy claro...yo no voy a hablar lo mismo todo esta en texto... para mi un 10... veremos si la Juez opina lo mismo. Aun queda TPS + Pro Se

Parker answer is "misconception"! They (Susman) believe all four had insider knowledge and traded on it!!

Sounds like Parker wants to go after more discovery as he tells the Judge that we just could not get all that was needed out of them. We got enough to show the IT but we feel there is a lot more to be found out!!!

Holy Moly!!! There must be some sick SNHs right now!!!

Criminal Charges

There is possibility of criminal charges in addition to billions of dollars.

Kaplan just indirectly accused Gropper of perjury,,,and Melwani via association. Nice.

Juicy, since the very beginning years ago, it has always not been just Civil Penalties in my mind. This has always been a Criminal Matter. And, it leads all the way to the top

Llevamos ya casi 9 horas... a ver si la Juez nos da una alegría y no se lleva el fallo a casita.

Continuamos el Lunes (Que empiece la especulación)

Here's my take on the Judge.

She asked a lot of questions of the "proponents" this morning. Straight to the point on the IT so she sounded VERY informed and I believe she gets it as Parker explained when he first started to speak .. because they had presented ""evidence"" and that's what her decision should be based on ... not all their different excuses.

Then, again, I believe she knows "sort-of" what she needs to do as far as the EC is concerned because she asked Parker straight out about his allegations against 2 SNHs or all 4. She needs to know who she's levying her ruling against.

NOW ... she has to figure out if she applies anything less than the contractural rate (which was an argument between JMW & Starke on which date to use ... so it sounds like she's given that much thought) ... who does the FJR apply to.

Then she has to decide on disallowances for which SNHs, which parties, and how much!!

So after deciding those issues, she sees the waterfall a lot differently and it just isn't working like Rosen proposed. Ahhh ... Rosen. Has he been lying to her and everyone else and what does she do with him.

How much are the NOLS worth and if there's enough money for equity, then how is WMMRC handled. She mentioned Chapter 7 earlier to Kaplan and they battled a bit over it being a Chapter 11 ... reorganized company.

SO ... just from all of that above, she has a number of decisions to make and just how to do because as close as numbers are things could shift drastically.

Oh ... yeah ... Parker reminded her if those negotiations made by the SNHs were to take care of their interest then the GSA was negotiated in bad faith. So there's another decision that has to be weighed out and carefully explained how she has to undo what she approved in the last confirmation.
