This is EXTREMELY dangerous because Walrath can get around Stern by simultaneously ruling that she has jurisdiction AND confirming the plan at the same time, thereby rendering her entire decision equitably moot.

As I feared, Judge Walrath has just said she can determine the limits of her jurisdiction later. She must not be allowed to delay the decision on jurisdiction because if the EC permits this she could rule that she does have jurisdiction and simultaneously confirm the plan, would would render both the jurisdiction question and all other issues equitably moot. This is impermissibly dangerous ground for the EC.

If the EC can't force her to rule on jurisdiction immediately then it MUST immediately file a motion to withdraw the reference to prevent her from adjudicating the plan.

I notified the EC about this and people here should do likewise to the EC and TPS counsel. I can't overstate the importance of this issue.

Hasta este momento la Juez ha denegado todos los intentos de Rosen de paralizar o desacreditar a nuestros testigos. Lo más importante es que el experto en Taxes del EC (BDO) autorizado a dar su testimonio por la Juez ha soltado la bomba que las NOL´s valdrian $23 Billones y no $2.5 Billones como dice Rosen... es una delgada linea pero es nuestra posición. Ojalá se pueda conseguir maximizar la estructura.

Lo mejor está por llegar con los temas de Insider Trading y Fraude a ser presentado por los accionistas de la calle... creo que ha llegado la hora de que este caso tome una nueva dirección y se empiece a hacer justicia.
