First of all I was hoping to get some community support for talking our pre-seizure longs who are still holding and who have not averaged down to at least consider doing so. Anyone see the movie "Poseidon Adventure" when the people refused to listen - help was coming. Please take the time to carefully consider these arguments as I would hate to leave anyone who was wronged behind.
1. Most pre-seizure longs are now post-seizure longs and have averaged down so those folks will take a settlement and sign the release form.
2. WMI will settle and no longer be pursuing a case against JPM so you will now have to front litigation costs of a class action suit -- all the way to verdict. My point is you will be a small number and have limited resources and even the most rightous case has to have the $$ to go the distance.
3. As far as settlement I see it the following ways:
a. Preferreds will either be assumed or paid out. I lean to the opinion that they will be assumed by JPM and you will get past dividends in cash and the market will take care of moving your shares close to PAR over time. JPM will retire these at its convenience over time.
b. The cash WMI will have come mid-March will be used to pay off the debt including WAHUQ.
c. Common shares will be a stock swap. Minimal dilution even at a 1JPM - 2WAMUQ conversion will be equal to about $19.00. Might be as low as 1-3 around $13.00. You have to remember that most got these below $0.20 cents and at $20.00 it is 100X what you paid.
I do not discount other scenarios I just try to be realistic in my expectations. I just do not see $40 a share in any scenario I can come up with outside of my emotinal involvement.
The only question I have on my mind is can JPM assume the preferreds at this point? and how soon will this happen?
The best I can determine is definitely prior to discovery occuring but has to occur after the NOL is refunded. This puts it in the March timeframe. I think the price of all classes gets stepped up week to week going into March so as to ease the shock of acquisition.

I can speak for myself and hope most longs feel the same.... This could go another few years as far as I am concerned to get max legal remedy/recourse and allow justice to deal out the consequences that JPM/jd and collaborators duly deserve..... I am in no rush for a quickie settlement and let the crooks get off from their evil deeds and just continue their rich lifestyle in the normal course of business...... If no one makes a stand to gain justice here then the destruction of WaMu will be for naught.... And JPM will just continue on their road of illicit arrangements and misdeeds.... Not the kind of USA I would want my children/grandchildren and future generations to be a part of....
