Your Shares Will Be Locked; EC Letter Doesn't Change DS or Plan
We need to keep in mind that the wording of the DS and plan override the contents of the addendum (i.e., letters).
This means that while the letters don't expressly say that your shares will be locked up the DS and plan do, and until and unless the DS and plan are amended to say that your shares will not be locked and will be freely tradable, they will be locked as soon as you vote.
P. 3 of the EC's letter (p. 15 of the PDF) does not mention non-liquidability (locking of shares, non-tradeability), but this is no comfort because the DS and plan do have that language.
All the EC is saying is that stock in the reorganized company may never be listed on any recognized stock exchange (e.g., NYSE, NASDAQ), and that it (not your current WMI shares -- which are free trading) might someday be on the OTCBB or Pink Sheets.
This is not nearly good enough. People who are concerned about having their shares locked need to have the EC and WMI assure that that won't be the case. The letter is cleverly worded, but doesn't change the fact that as things stand, if you vote, your shares (and money) will be locked for up to two years.
