The Judge is telling JPM to clean up their mess! Simple as That!
I said last year that this court does not want to rule on the issues surrounding the seizure, including valuation. Judge Walrath prefers that the parties work out their own mess and the District Court in D.C. would feel likewise.
Walrath is well aware that all JPM's machinations have been to avoid discovery (which would impel settlement) and minimize liability by hiding behind the P&A. This ruling is fair to the FDIC, hinders JPM, and shows Walrath understands FIRREA's circumscription of her power all too well.
If WMI and the FDIC are closer in objective than JPM is to the FDIC now would be the time for the FDIC to use a force majeure to bring JPM to heel.
June 24 (Bloomberg) -- Washington Mutual Inc., the former parent of the biggest U.S. bank to fail, should battle JPMorgan Chase & Co. for control of $4 billion in bankruptcy court, a judge ruled, potentially speeding up payments to creditors.
The ruling benefits Washington Mutual creditors, who say they will get paid much faster if U.S. Bankruptcy Judge Mary Walrath in Wilmington, Delaware, decides who owns the $4 billion, currently on deposit with JPMorgan. Walrath denied a request today from U.S. regulators and JPMorgan that she put off any decision on the cash until a federal court in Washington rules on a related lawsuit.
