In most bankruptcy cases big and small, the claims far exceed the assets and the equity owners of the failed business receive nothing while the unsecured creditors receive a few pennies on the dollar if they are fortunate. No equity committee is required since the company is hopelessly insolvent and the owners are out of the money. The WAMUQ case is significantly different as the cash assets are relatively close to the debts owed to the unsecured creditors (mostly WMI bondholders). After the receipt of tax refunds, it is even possible that just the cash assets of WAMUQ by themselves will exceed the balance owing to the unsecured creditors. In addition to the cash assets, there are apparently other significant non-cash assets that were illegally converted by the FDIC and transferred to JPM. There are also significant damages and claims that are the subject of ongoing litigation. Taken together, the existing assets, potential asset recovery, and litigation recovery appear to far exceed the balance due to the unsecured creditors. That was the case in mid-December 2009. However, the debtors appear to have been completely taken over by the non-equity unsecured creditors sometime around the middle of December, 2009, right after the debtors had filed their motion for expanded Rule 2004 discovery. If that is the case, the unsecured creditors could potentially become the new owners of WMI following the approval by the court of a POR and either collect a windfall recovery beyond their actual debt amount or end the recovery actions against other parties under their control and avoid recovery expense. In either event, such a process would have been fundamentally unfair to equity owners. The UST must have found out about this situation and then formed the Equity Committee a few days later on an emergency basis. The UST is reponsible for taking legal action to enforce the requirements of the Bankruptcy Code and to prevent fraud and abuse. For unsecured creditors to collect amounts beyond what is owed to them at the expense of current equity owners would be an abuse of the bankruptcy system. The UST obviously considered the formation of the EC to be an emergency action based on the timeline they asked for in open court. Since the apparent takeover, the debtors have been objecting to everything connected with the equity committee while proposing to give billions of dollars to JPM. The EC has now been allowed to intervene in the JPM adversary action in bankruptcy court which will allow them to represent the interests of current equity owners in that adversary action as well as the overall bankruptcy process.

Hola que tal una pregunta estaba implementando el formulario en el apartado donde dice acciones adquiridas a 3 de marzo yo las compre despues puedo de alguna manera sumarme a la iniciativa igualmente???

El tal Marcos es demasiado inteligente para mi, no consigo ver muy bien las relaciones que hace. Voy a esperar al domingo que esté descansado para intentar entender que tiene que ver la lluvia, el coche del vecino y la teoría del sentimiento contrario. Hasta ahí no llego, pero he de reconocer que mi deficit intelectual es alto.

Yo para la alta elucubración necesito un día de fiesta completo y el de hoy ya lo he llenado, pero para mi que se lía con el sentimiento contrario y la deducción lógica y su relación con la verdad. Esa es la esencia de todas las novelas de intriga, la dedución te lleva a una cosa pero te faltan criterios de verdad que es con lo que intenta sorprenderte el autor.
